Hosting & Service Policy
This policy describes the managed-hosting arrangement that comes with every Brimky plan and is part of your Terms of Service with Custom Software Solutions LLC.
1. Managed-service model — not raw hosting
Brimky provides managed hosting as part of a managed website service. Brimky is not a raw hosting-control-panel provider unless a separate written agreement says otherwise. Direct access to hosting-provider accounts, cPanel, WHM, DNS, databases, source files, file systems, SSH, or SFTP is not included by default.
2. Third-party infrastructure
Hosting may be provided through third-party infrastructure and upstream providers. Outages, suspensions, policy changes, or security incidents at those providers can affect our Services in ways outside our reasonable control.
3. Uptime
We aim to provide reliable service, but we do not guarantee uninterrupted, error-free, or secure availability unless a separate written service-level agreement expressly provides otherwise.
4. Maintenance
We may perform scheduled or emergency maintenance, including updates, patches, configuration changes, security measures, traffic blocking, or feature restrictions. Some maintenance may occur without advance notice where necessary for security or reliability.
5. Backups
We may maintain backups for operational purposes, but backups are not guaranteed unless expressly included in your plan. Client should keep independent copies of important content, media, records, and data. We do not guarantee the recoverability of any specific item from backup.
6. Resource limits
We may apply storage, bandwidth, CPU, memory, database, email, file, inode, or traffic limits to protect service quality, security, and other customers. Sustained excessive resource use may result in throttling, plan-tier review, or suspension.
7. Security
We may patch, update, disable plugins, block traffic, restrict scripts, reset credentials, or modify configurations where we believe necessary for security or reliability.
8. Client-caused problems
Client is responsible for issues caused by Client-provided content, scripts, third-party integrations, DNS changes, domain expiration, external services, or unauthorized access resulting from Client’s actions or credentials.
9. Domain registration and management
Brimky may provide domain search, registration assistance, renewal management, DNS configuration, SSL setup, and related domain-management services. Domain names are registered through third-party registrars (such as Namecheap) and are subject to the applicable registrar, registry, and ICANN rules. Brimky is not an ICANN-accredited registrar and does not provide registrar services directly.
Unless otherwise agreed in writing, Client is the intended registrant and owner of any domain registered on Client’s behalf. Client represents that it has the authority to register, purchase, transfer, configure, or request changes to any domain submitted to Brimky. Client is responsible for providing accurate, complete, and current registrant and contact information, for keeping such information current, and for ensuring that the domain name does not infringe the rights of any third party.
Brimky may require verification of identity, authority, account ownership, domain control, business authorization, payment status, or other information before registering, transferring, unlocking, releasing, modifying, or making DNS or registrant changes to a domain. Brimky may refuse or delay a domain-related request if Brimky reasonably believes the request may be unauthorized, fraudulent, disputed, inaccurate, unlawful, in violation of registrar or registry rules, or likely to harm Client, Brimky, the domain registrant, or a third party.
Domain availability and pricing are not guaranteed until registration is successfully completed and confirmed by the registrar or registry. Renewal prices, premium-domain prices, taxes, registry fees, privacy fees, redemption fees, restoration fees, and transfer fees may differ from initial registration prices.
Client authorizes Brimky to configure and manage DNS, nameservers, SSL verification, email-authentication records (SPF, DKIM, DMARC), redirects, and related technical settings as reasonably necessary to provide the Services.
Upon termination or upon Client’s verified request, Brimky will provide reasonable assistance to transfer domain management to Client or another provider, subject to payment of outstanding amounts, identity verification, technical limitations, and applicable registrar, registry, ICANN, transfer-lock, expiration, dispute, or payment restrictions. Domain names may be subject to transfer locks including a 60-day lock after initial registration or recent registrant-contact changes. Brimky is not responsible for domain loss, expiration, deletion, suspension, transfer denial, DNS failure, email disruption, or loss of domain rights caused by nonpayment, inaccurate information, Client delay, registrar policies, registry policies, third-party actions, legal disputes, or events outside Brimky’s reasonable control.
10. Website migration
If Client requests migration of an existing website, Client is responsible for providing accurate access credentials, confirming ownership or authorization to migrate the website, domain, content, media, databases, and related assets, and maintaining the prior hosting account until migration is complete. Brimky is not responsible for downtime, data loss, email disruption, missing assets, plugin or theme incompatibility, proprietary-platform limitations, DNS propagation delays, or issues caused by the prior host, registrar, or third-party services.
Some websites, including sites built on proprietary platforms (e.g. Wix, Squarespace, Shopify, Webflow, GoDaddy site builder), may not be transferable as-is and may require rebuilding, redesign, or manual recreation in our system.
11. Upstream provider pass-through
Client’s use of the Services is subject to applicable upstream provider policies (hosting-provider acceptable-use, resource, abuse, and anti-spam policies). See our Acceptable Use Policy for the rules we flow down.
